House Crypto Tax Bill Proposes $10 Fee Exemption but Excludes Staking Tax Relief

The House Ways and Means Committee has released a 114-page crypto tax bill, with a committee markup scheduled for Wednesday at 10 a.m. ET. The Digital Asset Tax Certainty Act, introduced by Chairman Jason Smith, includes a provision to exempt network or transaction fees of $10 or less from capital gains tax, effective after December 31, 2027. However, the bill classifies income from digital asset validation as ordinary income, omitting the flexible tax treatment for miners and stakers previously discussed. Additionally, the bill extends wash-sale rules to digital assets.
